01About these terms
These terms apply to your use of www.dynepta.com (the “website”). By using the website you agree to them. If you do not agree, please do not use the website.
Clauses that limit our liability or place obligations on you are in bold, as the Consumer Protection Act 68 of 2008 requires where it applies.
02Who we are
The website is operated by [Registered company name], trading as Dynepta, registration number [CIPC registration number]. Our full company details, physical address and address for service of legal documents are on our Company information page.
03Our services
The website provides general information about our services. It is not an offer, and no services can be ordered or paid for through it. We provide services only under a written agreement signed by both parties (a master services agreement, scope sheet and data processing agreement), which sets out the services, price, payment terms and duration. If these terms and a signed agreement conflict, the signed agreement applies.
04Information on this website
We work to keep the website accurate and up to date, but its content is general information only. It is not legal, regulatory or compliance advice, and you should not rely on it as such. In particular:
- Descriptions of how our platform supports compliance with POPIA describe our design. As the responsible party for your own data, your organisation remains responsible for its own compliance.
- Product screens and examples on the website use fictional sample data (for example, the client “acme”). They illustrate how the platform works and are not real client information or results.
- Availability of Google Cloud services in a particular region is confirmed for each client during onboarding.
05Intellectual property
The website, its text, design, graphics and logos, and the Dynepta toolkit it describes, belong to Dynepta or its licensors and are protected by copyright and other intellectual property laws. You may view and print pages for your own information or your organisation’s internal evaluation of our services. You may not copy, republish, sell or create derivative works from the website or its content without our written permission.
Google Cloud, BigQuery, Looker, Looker Studio, Datastream, Cloud Run, Cloud Monitoring and related marks are trademarks of Google LLC. Terraform is a trademark of HashiCorp. Other names belong to their owners. Their use on this website describes the technology we work with and does not imply any endorsement or partnership.
06Acceptable use
When using the website you must not:
- try to gain unauthorised access to the website, its servers or any connected system;
- interfere with or disrupt the website, or introduce malware;
- use automated tools to copy or scrape the website in bulk;
- use the website for anything unlawful, including any offence under the Cybercrimes Act 19 of 2020.
If you find a security weakness, please report it to [security@ email address] rather than testing it further. See our security.txt.
07Links to other websites
The website links to third-party websites, such as Google’s and the Information Regulator’s. We do not control them and are not responsible for their content or privacy practices.
08Availability and liability
We provide the website “as is” and do not guarantee that it will always be available, uninterrupted or free of errors.
To the extent the law allows, Dynepta is not liable for any loss or damage, whether direct, indirect or consequential, arising from your use of, or inability to use, the website or from your reliance on its content. Nothing in these terms limits liability that cannot lawfully be limited, including liability for gross negligence or fraud, or any right you have under the Consumer Protection Act where it applies to you.
09Electronic communication
When you email us or we email you, you agree that this electronic communication satisfies any legal requirement for communication in writing, as provided for in the Electronic Communications and Transactions Act 25 of 2002. A message is treated as received when it enters the recipient’s mail system and can be read.
How we handle personal information you send us is explained in our Privacy notice.
10Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa. You agree to the jurisdiction of the South African courts, specifically [e.g. the Gauteng Division of the High Court, Johannesburg], for any dispute arising from them.
